Douglas, 46, has been on the bench since 1974. Joggers Criticized About Median Strip Continued From First Page Howard Mack Elliot, 29, of Charlotte, N.C., was returned in custody of Richmond detectives yesterday.

He was charged with attempted murder, shooting into an occupied building, felonious and malicious assault and use of a firearm in the commission of a felony. Hutchins, 48, suffered an eye injury and facial burns when acid was thrown into his face at the Hut restaurant at 903 N. Davis Ave. Dec. 23.

According to police, Hutchins was seated at his restaurant when a man sitting next to him asked whether he was Sonny Hutchins. When Hutchins looked up, a man threw a glass full of acid in Hutchins' face. The manager of the restaurant, Mason Kirby, chased the man and was shot at twice before Hutchins' assailant escaped. Hutchins races late-model sportsman cars at Southside Speedway. Richmond detective T.C.

Mann said Elliott was arrested in February in Charlotte after a search warrant was executed at his home. Mann said Elliot was returned to Richmond yesterday after extradition papers were approved by North Carolina governor James B. Hunt Jr. Avenue historic district calls for spending more than $300,000 in 1977-78 and an equal amount, or perhaps more because of inflation, in 1978-79, according to the Public Works Department. The improvements include planting trees, installing new street lights, curb and gutter work, and installing wheelchair ramps at sidewalks.

The improvements, Hendriksen said, are an attempt to make as it used to be years ago. Now, it is actually kind of ruined by people who are, maybe you call it selfish. using it for walking pets. People are very inconsiderate." Pets, he said, should use the gutter area as a bathroom, and a city ordinance requires that the pet owner scoop up and remove feces. "MAYBE WHEN JOGGERS find out what they are really doing to a beautiful area they might start thinking twice.

They should know that if they are walking a Hendriksen said. There are, he said, "places for jogging, certainly, but why not go out to Byrd Park or an athletic area and do the jogging there, or do it on the sidewalk," he suggested. One jogger who runson Monument Avenue, about 50 percent of the time on the median strip, responded to Hendriksen's comments with his own complaint. don't have a jogging path in the city," he said. "I run on the sidewalks and I like it myself, but a lot of people don't," he said, because of increased risk of foot and knee ailments.

"I DON'T THINK there's any question about it. It's safer running on a cushioned surface, more enjoyable, and the runner has a less probable chance of injury," said Bill Jordan, a University of Richmond associate professor of physical education who helps with the university's track program. "There are those who can run on a hard surface," Jordan said, but "they are few, and mostly young." Jordan suggested that park officials solicit cooperation of joggers not to run in the same path all the time.

"It's sone of the nicest places to run, right down Monument Avenue," he said. However, he said, the park and recreation officials have a legitimate complaint about worn paths on the median strip. Grass seed won't germinate in the paths, Hendriksen said. "When they stay off, then we would plow up and reseed." SPENCE NOTED that landscaping a highway in an urban area is more involved and more a costly than normal landscaping because of the proximity to residential areas and the need to be more selective of what is planted. The contract also calls for maintenance during the first year after the planting is completed, he said, including watering, spraying if needed and replacing plants that die.

The money also will pay for some road maintenance work, he said. That is chiefly putting bituminous concrete under some of the guard rails, which a will eliminate the need for mowing under the barriers, a time-consuming process. Although aesthetically pleasing, the project also points out the fact that almost nothing involved in highway construction comes cheap. DUE TO THE DEATH OF MRS.
